These Terms of Service ("Terms") govern your use of Mutual, a service designed to help couples discover shared interests and desires through private matching. By using Mutual, you agree to these Terms.

Please read these Terms carefully. If you don't agree with them, please don't use our service.

What Mutual Is

Mutual is a platform that helps couples communicate about intimate topics by:

• Allowing each partner to privately answer questions about their interests and desires
• Showing only the topics where both partners have expressed interest
• Providing a safe space for discovery without fear of rejection

Mutual is designed for consenting adults in relationships who want to improve their communication.

Eligibility

To use Mutual, you must:

• Be at least 18 years old
• Be capable of forming a binding contract
• Not be prohibited from using the service under applicable law

By using Mutual, you represent and warrant that you meet these requirements.

Your Account

Account Creation

You're responsible for maintaining the security of your account credentials. Don't share your password with anyone.

Accurate Information

You agree to provide accurate information when creating your account and to keep it updated.

One Account Per Person

Each person should have only one Mutual account. Creating multiple accounts may result in termination.

Using Mutual Responsibly

Consent and Communication

Mutual is a tool for communication, not a substitute for consent. Matching on a topic in Mutual:

• Indicates mutual interest in discussing a topic
• Does not constitute consent to any activity
• Should always be followed by real conversation with your partner

Respect Your Partner

Use Mutual with respect for your partner's boundaries. A match is an invitation to talk, not an obligation to act.

Prohibited Uses

You may not use Mutual to:

• Harass, abuse, or harm another person
• Violate any applicable laws or regulations
• Attempt to access another user's account
• Interfere with the proper functioning of the service
• Use automated systems to access the service
• Reverse engineer or attempt to extract source code

Privacy and Your Data

Your privacy is fundamental to Mutual. Our Privacy Policy explains how we collect, use, and protect your information.

Key points:

• Your individual answers are never shared with your partner
• We never sell your data
• You can delete your account and data at any time

Intellectual Property

Mutual and its original content, features, and functionality are owned by Mutual and are protected by international copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, or create derivative works from any part of Mutual without our express written permission.

Service Availability

We strive to keep Mutual available and functioning properly, but we can't guarantee uninterrupted service. We may:

• Temporarily suspend the service for maintenance
• Modify features to improve the service
• Discontinue the service with reasonable notice

Pricing and Payments

Mutual is currently free during our founding period. When we introduce paid features:

• We'll provide advance notice of pricing changes
• Founding members keep access to features they've already unlocked
• All payments will be processed securely through established payment providers

Termination

By You

You can stop using Mutual and delete your account at any time through your settings.

By Us

We may suspend or terminate your account if you violate these Terms or if we need to protect other users or the integrity of our service. We'll provide notice when possible.

Disclaimers

Mutual is provided "as is" without warranties of any kind, either express or implied. We don't guarantee that:

• The service will meet your specific requirements
• The service will be uninterrupted or error-free
• Any results from using the service will be accurate

Mutual is a communication tool. We're not responsible for the outcomes of conversations or activities that result from using our service.

Limitation of Liability

To the maximum extent permitted by law, Mutual shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the service
• Any unauthorized access to or use of our servers
• Any bugs, viruses, or similar issues transmitted through the service

Changes to These Terms

We may update these Terms from time to time. If we make significant changes, we'll notify you through the app or via email at least 30 days before the changes take effect.

Your continued use of Mutual after changes become effective means you accept the new Terms.

Governing Law

These Terms are governed by the laws of the United States, without regard to conflict of law principles.
